Definitions

‘The Organiser’ - the individual who on behalf of any individuals, group, company or organisation has signed the Booking form.
‘The Party’ – the individuals to whom the activities or services will be provided.
‘The Participant ‘ the person who is driving the kart or quad.
When an individual books on their own behalf the terms and conditions of ‘the organiser’ and ‘the party’ will also apply.
‘Guest’ any individual who is not a participant but is associated with the party.
‘Website’ – refers to www.team-action.co.uk
‘In writing’ – includes correspondence by letter fax and email.
‘Contract’ – the agreement between Team Action Ltd and the organiser, which comes into existence when Team Action Ltd accepts the deposit from the organiser and issues the booking confirmation in writing.

Authority

The organiser will be the point of contact for the party and upon payment of the deposit confirms that they have the authority to act on behalf of all other members of the party.
The organiser will be responsible for communicating the Terms and Conditions to all participants and guests of the party
If the organiser is no longer acting as the group leader, Team Action Ltd should be notified in writing immediately.
No correspondence will be entered into with any other member of the party unless this condition is fulfilled.

Pricing

The price of the activities is as stated on the current Team Action Ltd Price List.
Team Action Ltd reserve the right to change the price of activities prior to receipt of the deposit.
Price increases will not be added to any confirmed bookings.
All prices are in pounds sterling and are inclusive of VAT unless stated otherwise.

Booking

Bookings may be made over the telephone or by submitting an online booking form.
All participants must be 16+ years of age and will be required to confirm this when completing their booking form
Bookings taken over the telephone will require completion of the booking form either online or in writing by the organiser.
The organiser is required to send a payment of £10 per person for each participant. This payment is non refundable and forms a contract between the Customer and Team Action Ltd.
Upon receipt of the non-refundable deposit Team Action will issue a booking confirmation to the organiser together with full details of the activity or event.

Payment

The organiser is responsible for collecting monies from the Party and making payments to Team Action Ltd.
Payment can be made by cheque, credit or debit card.
Cheques should be made to ‘Team Action Ltd’.
Any cheques which do not clear on presentation will be subject to an additional charge of £20.00
The final balance to be paid in full 21 days before the event date.
Team Action Ltd reserve the right to consider failure to make payment of the balance on the due date as a cancellation.

Safety

All participants must be 16+ years of age and will be required to confirm this when completing their booking form
A compulsory safety briefing will be held at the beginning of each event. All event participants must attend the safety briefing. Failure to do so will mean that participant will not be allowed to participate in the activity and monies paid will be non refundable
All safety equipment, helmets and coveralls will be supplied for each activity.
Participants must wear sensible/own footwear and clothing suitable for the weather conditions and activities provided. Suitable footwear including but not limited to walking boots, boots or trainers.
Participants who bring their own safety equipment must allow inspection and approval from a Team Action Ltd marshal before being used.
Participants are required to operate the vehicles safely and behave in a manner that does not put themselves or others at risk. Team Action Ltd reserves the right to withdraw any participant in the Party and/or cancel an activity or event should any participant’s behaviour cause concern for the safety of others. Any monies paid will be non refundable.
Karting and Quading is a non-contact sport. Any participant deliberately or consistently causing contact with another vehicle will be withdrawn from the activity or event and monies paid will be non refundable.
Any participant driving dangerously or in any way deemed to be causing unnecessary damage to karts or quads or property will be withdrawn from the activity and any monies paid will be non refundable.
Participants must not be under the influence of drugs or alcohol before or during an activity or event. This will always result in the participant being excluded from the activities and monies paid will be non refundable
Participants who have an Illness or other condition that may be affected by physical exertion or driving on rough terrain are advised not to participate and do so at their own risk. Team Action Ltd advise anyone concerned about their health in relation to our activities or events to consult their GP before booking.
All participants and guests use Team Action Ltd facilities at their own risk. Team Action Ltd will accept no responsibility for any illness or injury howsoever caused.
Team Action Ltd cannot accept liability for any accident to any participant or guest that may occur on the premises
Any participant or guest, who suffers an accident on Team Action premises, must report the accident immediately to a Team Action Ltd member of staff.

Activities/Events

All activities and events descriptions are outlined on the website and in the brochure. Every effort has been made to describe the activities accurately however some small changes may occur from time to time.
All times listed are approximate and may vary.
The time allocated for your karting or quad activity or event will include the compulsory safety briefing, changing into safety wear as well as the actual karting or quading. If you arrive late it will affect your time on the track.
Karts and Quads will run in all but the most severe weather conditions. Waterproofs will be supplied in the event of bad weather. However should the weather conditions be so severe as to jeopardise the safety of the party, Team Action Ltd reserve the right to postpone the event and issue a credit note, so the event can be rearranged.
Team Action Ltd will make every effort to repair any kart or quad that is broken down. Customers must be aware that there may be occasions where repairs may not be resolvable on the day but every effort will be made to offer an alternative vehicle within the activity or event however this cannot always be guaranteed.

Parking

Free parking will be provided by Team Action Ltd
Vehicles, motorcycles, and bicycles, parked or left in the Team Action Ltd car park or elsewhere on the premises and all contents in them or on them, are left at the owners risk.
All personal possessions remain the responsibility of participants and guests at all times. Team Action Ltd accept no responsibility for any lost or stolen items on the premises.

Refunds/Cancellations

Once Team Action Ltd has received payment of the deposit and final balance all monies are non-refundable.
Should the party reduce in numbers following payment of the deposit, the deposit will be forfeited for those members of the party not attending.
Should the party number fall to less than the minimum group size for that activity Team Action Ltd reserve the right to offer a substitute activity, or offer an alternative date if the required number of participants are not available from another party to run the activity session.
Where the party is made up of single bookings and the party number falls below the required number of participants then Team Action Ltd reserve the right to a substitute activity or offer alternative date.
If the party or any participant decides not to partake in any part of the activities or events for any reason on the day, Team Action Ltd will give no refund.
Team Action Ltd may cancel any activity or event, for example, but not exclusively, when bad weather makes an activity unsafe. Team Action Ltd reserves the right to substitute an alternative activity at short notice.
Team Action Ltd accepts no liability for any costs incurred by the organiser or party as a result of the cancellation other than the difference between the price of the cancelled activity and the price of the substituted activity.
