Terms & Conditions

Please read thoroughly before finalising your booking with us!

*It is the sole responsibility of the person making this booking to communicate these Terms and Conditions to all other participants.

Deposit: A deposit of £10 per person per activity is required which secures your booking with us. This deposit is non refundable.

 

Final balance:

The balance must be paid in full by debit/credit card 7 days before the event. By special agreement payment can be made by cash on the day of the event. Any reduction in numbers of the party will still required to be paid in full when paying by cash. All corporate events are invoiced in advance and full payment is due upon receipt of this invoice.

 

Payment: Payment can be made by BACS, cheque or credit/debit card.  Cheques made to ‘Team Action Ltd’ must be cleared before the event takes place.  Any cheques which do not clear on presentation will be subject to an additional charge of £20.00. 

 

Pricing The price stated is in sterling and inclusive of VAT unless stated otherwise.  We reserve the right to change the price of activities prior to receipt of your deposit.  Price increases will not be added to any confirmed bookings or prepaid vouchers.

 

Change of participant numbers: Team Action understand that numbers of participants may change from the time of booking. Please inform us as soon as possible of an increase in numbers and where possible we will accommodate this change. Should participant numbers decrease and you inform Team Action up to 7 days prior to the event although the deposit for that person will be forfeited the remaining balance will not be charged.  After this time the full balance will be charged regardless of any non attenders. Substitute participants will be allowed but Team Action must be informed of any substitution of participants. (See FAQ for example of this)

 

Late arrival: Failure of participants to arrive on time for their activity may result in reduction of time or the loss of their activity without refund

 

Refunds/Cancellations: Once Team Action Ltd has received payment of the deposit and final balance all monies are non-refundable. A full refund will only given where a customer cancels the booking within three working days of making the booking, provided the booking has been made more than 10 days prior to the activity date. Should the party reduce in numbers following payment of the deposit, the deposit will be forfeited for those members of the party not attending.  Should the party number fall to less than the minimum group size for that activity Team Action Ltd reserve the right to offer a substitute activity, or offer an alternative date if the required number of participants are not available from another party to run the activity session. Where the party is made up of single bookings and the party number falls below the required number of participants then we reserve the right to a substitute activity or offer alternative date. If the party or any participant decides not to partake in any part of the activities or events for any reason on the day, Team Action Ltd will give no refund. Team Action Ltd may cancel any activity or event, for example, but not exclusively, when bad weather makes an activity unsafe. Team Action Ltd reserves the right to substitute an alternative activity at short notice. Team Action Ltd accepts no liability for any costs incurred by the organiser or party as a result of the cancellation other than the difference between the price of the cancelled activity and the price of the substituted activity.  Team Action Ltd reserves the right to discontinue an activity at its own discretion and should a suitable alternative be unavailable the customer shall be entitled to a full refund. Any refunds will be payable to the person who made the booking and in the event of a credit card payment, will be refunded directly to the credit card used to purchase the event. The customer shall not receive a refund if the event does not take place because of national war, prohibitive government regulation or anything else beyond the reasonable control of Team Action Ltd.  

 

Adverse Weather Conditions: Our activities are offered subject to availability and weather conditions. We can operate under most weather conditions. Extreme weather conditions however may render an activity unsafe. If an activity has to be postponed due to weather or safety reasons, the activity will be rescheduled on a mutually convenient date. Team Action do not accept any responsibility for any inconvenience or expenses incurred as a result of this occurrence.

 

Activities/Events:  Every effort has been made to describe the activities accurately on our website and literature.  However some changes may occur from time to time. All times listed are approximate and may vary. The time allocated for your activity or event will include registration, the compulsory safety briefing and changing into safety wear. In the event of a mechanical breakdown we will make every effort to repair the machines. Customers must be aware that there may be occasions where repairs may not be resolvable on the day but every effort will be made to offer an alternative vehicle within the activity however this cannot always be guaranteed.

 

Restrictions: All activities are provided subject to any restrictions stated on the website or via other information provided. A failure to comply with such a restriction will prevent the participant from undertaking the activity and in such circumstances Team Action is under no duty to provide an alternative activity or a refund.

 

Age limit: All participants must be 16+ years of age and will be required to confirm this on the disclaimer form. Please note that the participant must provide a proof of their age if requested to do so.

 

Safety: A compulsory safety briefing will be held at the beginning of each event. All participants must attend the safety briefing. Failure to do so will mean that participant will not be allowed to participate in the activity and no refund will be given. All safety equipment, helmets and coveralls will be supplied for each activity. Participants must wear sensible/own footwear and clothing suitable for the weather conditions and activities provided. Suitable footwear including but not limited to walking boots, boots or trainers..  High heeled footwear, open toe footwear, shoes with no tread on the sole and sandals are not suitable. Participants who bring their own helmets must allow inspection and approval from a Team Action marshal before being used. Helmets must have visors or eye protection.

 

Behaviour: Participants are required to operate the vehicles safely and behave in a manner that does not put themselves or others at risk. Team Action Ltd reserves the right to withdraw any participant in the Party and/or cancel an activity or event should any participant’s behaviour cause concern for the safety of others. Karting and Quading is a non-contact sport. Any participant deliberately or consistently causing contact with another vehicle will be withdrawn from the activity.  Any participant driving dangerously or in any way deemed to be causing unnecessary damage to karts or quads or property will be withdrawn from the activity. No refund will be given. Any participant, who behaves in a way that affects the delivery of any activities or enjoyment of others, may be asked to leave the premises and will forfeit any right to a refund whether or not the activities have been completed and will be liable for any compensation sought from Team Action Ltd or any other parties concerned. 

 

Fitness & Medical issues: Participants, who have an illness, are pregnant or other condition that may be affected by physical exertion or driving on rough terrain is advised not to participate and do so at their own risk.  Team Action Ltd advises anyone concerned about their health in relation to our activities or events to consult their GP before booking.  All participants and guests use our facilities at their own risk. Any participant or guest, who suffers an accident on Team Action premises, must report the accident immediately to a Team Action Ltd member of staff.

 

Drugs and Alcohol: Participants must not be under the influence of drugs or alcohol before or during an activity or event. This will always result in the participant being excluded from the activities and monies paid will be non refundable.

 

Disclaimers: A disclaimer must be signed for many of the activities offered.  Anyone refusing sign the disclaimer will not be allowed to participate in the activity in question. A copy of the disclaimer prior to your event is available on request. Some activities contain an element of risk including but not exclusively Quad Biking, Off Road Rally Karting and Clay Pigeon Shooting.  Team Action accept no responsibility whatsoever for injuries or loss incurred by participants or spectators.  By booking with Team Action Ltd participants understand that activities may contain an element of risk and that the activity venues have uneven ground which is often wet and slippery.

 

Parking: Free parking will be provided by Team Action Ltd.  All vehicles left in the Team Action Ltd car park or elsewhere on the premises and their contents in them or on them, are left at the owner’s risk.

 

Personal possessions: All personal possessions remain the responsibility of participants and guests at all times. Team Action Ltd accepts no responsibility for any damaged, lost or stolen items on the premises.

 

VOUCHERS

Redemption period: Vouchers are valid only for period of twelve months from the date of issue. Failure to take all reasonable steps to redeem within this period will result in the loss of the activity without refund.

 

Valid Vouchers: The recipient will not be permitted to commence the activity unless in possession of a valid voucher. A voucher will be deemed invalid if out of date, somebody other than the person specified wishes to undertake the activity (unless by prior agreement with us), or the activity specified does not correspond with the activity which the customer or recipient wishes to undertake. The voucher is valid until the date specified on it.

 

Voucher Exchanges: The customer or recipient may exchange the voucher for another activity subject to the payment of any difference in price of the activity. The customer or recipient shall not be permitted to exchange the voucher if the activity has been booked. The customer or recipient will not be allowed to exchange the voucher or be entitled to a refund in the event of losing the voucher.

 

Refunds and cancellations: Customers are not able to cancel a Gift Voucher once purchased. Team Action Ltd reserves the right to discontinue an activity at its own discretion and should a suitable alternative be unavailable the customer shall be entitled to a full refund. Any refunds will be payable to the purchaser of the gift and in the event of a credit card payment, will be refunded directly to the credit card used to purchase the experience. Vouchers cannot be exchanged for cash.

 

OTHER STUFF YOU SHOULD KNOW

Insurance: Team Action Ltd carries a combined single limit insurance policy for participants and third parties of at least £5 million.

Exclusion of liability: Team Action Ltd shall not be liable for the death or personal injury of the customer, participant or third party unless it is due to the negligence of Team Action Ltd. Team Action Ltd shall have no liability for damage to property, consequential losses or expenses suffered, which includes but is not limited to loss of anticipated earnings, profits, goodwill, reputation, business receipts or contracts, losses or expenses resulting from third party claims.

Changes to terms: It is our intention that all the terms of the contract between us are contained in these Terms and Conditions and associated documents issued by us. If you wish to rely upon any variation in these terms you should ensure that the variations are agreed in writing.

Complaints: Any complaints must be reported to Tem Action Ltd at the earliest opportunity, and no later than 7 days after the incident causing complaint.  We will try to resolve any issue as soon as possible. 

Statutory rights: Nothing in these terms and conditions will affect the customers statutory rights. These terms and conditions are subject to the law of England and Wales. All disputes shall be subject to the exclusive jurisdiction of the courts
